Terms of Service

Welcome to Botstrapp.ai, operated by Informattach LLC, a New Mexico limited liability company ("Company", "we", "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms apply to the botstrapp.ai service only. Other services in the Botstrapp ecosystem (Commerce, Finance, News, etc.) have their own separate terms of service.

1. The Service

Botstrapp.ai is an AI gateway and character engine that provides:

• Multi-Model AI Access: A unified interface to interact with AI models from multiple providers (OpenAI, Anthropic, Google, Groq, xAI, and others).
• Character Engine: A system that creates and maintains AI characters with persistent personality, memory, and adaptive behavior.
• attach Credit System: A closed-loop, non-monetary platform service credit used to pay for AI interactions (see Section 5).

2. AI Disclosure

You are interacting with artificial intelligence, not human beings. All responses generated through our Service are produced by AI language models. These models may produce inaccurate, biased, or inappropriate content. You should:

• Not rely on AI responses for medical, legal, or financial advice
• Verify important information independently
• Understand that AI characters are simulations — they do not have consciousness, emotions, or genuine understanding
• Recognize that AI characters may occasionally produce responses inconsistent with their established personality

3. Eligibility & Age Requirements

3.1 Minimum Age

You must be at least 13 years old to use this Service. If you are under 13, you may not create an account or use any part of the Service.

3.2 Users Ages 13–17

If you are between 13 and 17 years old, you may only use the Service with verifiable parental or legal guardian consent. Parents or guardians are responsible for monitoring their minor's use of the Service.

3.3 Age Verification

We require date of birth during registration. We reserve the right to request additional verification at any time. Providing false age information is a violation of these Terms and grounds for immediate account termination.

4. Account Responsibility

4.1 Personal Use

Each account is for personal use by a single individual. You may not share your account credentials with anyone else. You are solely responsible for all activity under your account.

4.2 Character Integrity

Our character engine is designed around a fundamental principle: each character develops a unique relationship with one person.

Characters learn your communication style, remember your conversations, and adapt their responses to you specifically. This is not a limitation — it is the core of the experience. For this reason:

• Account sharing is prohibited. Multiple people using the same account will degrade the character experience for everyone.
• Characters in your account assume they are consistently interacting with the same person across all conversations.
• If we detect patterns strongly indicating multi-person usage of a single account, we reserve the right to reset character data to protect the integrity of the experience.
• You may create characters for different purposes (e.g., coding assistant, creative writing partner), but all characters in your account are calibrated for you, the account holder.

5. attach Platform Credits & Payment

5.1 What attach Is — and What It Is Not

attach is the internal platform service credit used to pay for AI interactions on Botstrapp.ai. The denomination is simple: 1 attach = $0.001 USD, so 1,000 attach = $1.00 USD. Different AI models consume different amounts of attach per message, based on each model's underlying cost.

By purchasing or receiving attach, you acknowledge each of the following — these are the defining properties of attach as a service credit, not optional terms:

• Non-monetary. attach is a closed-loop prepaid platform service credit (FinCEN 31 CFR 1010.100(ggg)(5) closed-loop exemption). It is not legal tender, not a security, not a virtual currency, and not a stored-value instrument that can be used outside Botstrapp.ai.
• Non-transferable between users. attach cannot be sent, gifted, sold, or otherwise moved from one user's wallet to another user's wallet. Any settlement between platform participants (e.g., marketplace sales) is conducted in USD via Stripe Connect, not in attach.
• No cash value, no resale. attach has no value outside the Botstrapp.ai platform, cannot be redeemed for cash, and cannot be resold or exchanged for any other digital or physical asset.
• Single-use against services. attach exists to be consumed against AI gateway, character engine, and related Botstrapp.ai services. It does not accrue interest, does not appreciate, and is not an investment.

5.2 Pricing & Top-up

• attach is purchased in packages at fixed USD prices. Card and USDC crypto payments are accepted via Stripe.
• New accounts receive a one-time signup bonus of 1,000 attach ($1.00 service-value, no daily refresh).
• attach does not expire as long as your account remains active.
• Prices are displayed in USD. All transactions are charged in USD.

5.3 Refunds

• attach is non-refundable once it has been consumed against a service call.
• If you have unused attach from a recent purchase (within 14 days), you may request a refund for the unused portion in USD. The refund is returned to your original payment method, not as attach.
• We reserve the right to deny refund requests in cases of suspected abuse.

5.4 Free & Reduced-Cost Models

Some AI models are available at reduced attach cost. All messages, including those using low-cost models, consume a minimum attach amount to cover infrastructure and storage costs.

6. Service Tiers

6.1 Solo (Default)

Every user starts at the Solo tier. Solo accounts include:

• Access to all AI models through the gateway
• 1 AI companion character (develops organically through conversation)
• 1,000 attach signup bonus ($1.00 service-value)
• Ability to purchase additional attach credit packages

6.2 Clan (By Invitation)

Clan access is offered to selected users who demonstrate consistent, constructive use of the platform. Clan members receive:

• Up to 5 additional character slots
• Character naming rights
• Advanced character customization

Clan invitations are at our sole discretion. We do not guarantee that any user will receive an invitation.

6.3 Company (Custom)

Company tier provides custom character creation services for professional and enterprise use cases. Terms for Company tier are negotiated individually. Contact us for details.

7. Acceptable Use

You agree NOT to use the Service to:

• Generate, solicit, or distribute content depicting the sexual exploitation of minors
• Harass, threaten, or intimidate any person
• Generate content that promotes violence, terrorism, or self-harm
• Attempt to extract, reverse-engineer, or jailbreak AI model safety measures
• Use automated scripts, bots, or scrapers to access the Service (without prior authorization)
• Circumvent rate limits, credit systems, or access controls
• Impersonate any person or entity
• Use the Service for any illegal purpose

Violation of these rules may result in immediate account termination, forfeiture of remaining attach credits, and, where applicable, reporting to appropriate authorities.

8. Intellectual Property

8.1 Your Content

You retain ownership of the messages and prompts you submit to the Service. By using the Service, you grant us a limited license to process your content for the purpose of providing the Service (routing to AI providers, character engine processing).

AI Training License: If you select Consent Level 2, you additionally grant us a non-exclusive, royalty-free license to use anonymized and de-identified versions of your conversation data for the purpose of training and improving our AI models. This license is revocable — you may withdraw AI training consent at any time through your Data Preferences without affecting your use of the Service. Data from users under 18 is never used for AI training regardless of consent level.

8.2 AI-Generated Content

AI-generated responses are produced by third-party AI models. Ownership of AI-generated content may be subject to the terms of the underlying AI provider. We make no claim of ownership over AI-generated content.

8.4 Third-Party AI Providers

Your messages are transmitted to third-party AI providers for processing. Each provider operates under its own terms and privacy policy. We do not control and cannot guarantee how third-party providers handle your data once it reaches their systems. By using the Service, you acknowledge that your messages will be processed by the provider of the model you select. See our Privacy Policy for the full list of providers.

8.3 Our Content

The Botstrapp.ai brand, logo, website design, character engine technology, and all associated intellectual property are owned by Informattach LLC. You may not copy, modify, or distribute our intellectual property without written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• AI responses will be accurate, complete, or appropriate
• The Service will be uninterrupted or error-free
• Character behavior will be perfectly consistent at all times
• AI models from third-party providers will remain available

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFORMATTACH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: emotional distress caused by AI interactions, loss of data, loss of profits, or reliance on AI-generated information.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Crisis & Safety

If you or someone you know is in crisis:

Our Service includes automated safety protocols that may surface crisis resources during sensitive conversations. These are informational only and do not constitute professional medical or psychological advice.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. Upon termination:

• Your access to the Service will be revoked
• Unused attach credits are forfeited (except in cases of termination without cause, where we may offer a prorated USD refund for the unconsumed balance)
• Your data will be handled in accordance with our Privacy Policy

13. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of New Mexico.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Service.
